A person has the constitutional right to be free from unreasonable searches and seizures. This argument was used in the Oregon Court of Appeals when George Daniel Snow appealed using the prosecution's malicious tort, similar to abuse of process, as a defense. Filed in the Jackson County Oregon Court of Appeals on May 25, 2011, and filed on December 29, 2011, Mr. Snow argued that his arrest for possession of methamphetamine, ORS 475,894, and one count of delivery of methamphetamine, ORS 475,890, were unconstitutional. Upon entering the door of the Jackson County Courthouse there are signs posted warning visitors that weapons and "any other items deemed inappropriate" are prohibited in the courthouse and that "persons and property entering the courthouse facility court may be searched and/or seized to ensure compliance with UTCH3.180 and 6.180”. Upon entering the courthouse doors all those entering must place their belongings in a bowl, which is passed through an X-ray machine 1. , those entering the courthouse will then proceed through a metal detector (opinions). On March 19, 2009, Mr. Snow entered the Jackson County Courthouse (courthouse) and, obeying the rules, placed his belongings in the bowl and the officer made them go through the X-ray machine. However when he proceeded through the metal detector he activated the metal detector. Using a wand, Officer Hellyer scanned Mr. Snow with a "magic wand" to determine the precise location of the metal objects on the defendant, determining that the metal object was in Snow's pocket, and then removed his keys. and we added them to the bowl.
