Jacoby believes that the death penalty protects society by threatening future murders with fear. Gaes believes the death penalty is necessary because overpopulation in prisons causes emotional and physical distress. The strongest aspect of the debate appears to be that the death penalty does not deter crime at all or help the victim's family heal.
