Emile Durkheim advances the sociological theory that individuals are largely a product of their environment. Thus, societies directly influence the prospects and qualities of life of their members. The same theory can apply to the American correctional system. Segregation in prison, whether based on race, gang membership, or religion, allows for the reinforcement of group mentality within the individual through cultural transmission. Instead of rehabilitating, therefore, the correctional system merely further socializes a criminal mentality among its inmates that directly contributes to the high rates of rearrests within a three-year period following release. Reintegration into society is unfair for individuals (criminals) and for society! First we return to the theories of punishment, these theories, which are used by the judicial system not only here, but on the basis of the common laws that have been formed. This excerpt will focus on rehabilitation and a bit on punishment. The trials of these individuals aim to repay the social damage they have caused to society. Social harm by definition is the recognition of what society has deemed and classified as social harm. In other words, what people heard violates norms and living standards. Second, we understand the means of rehabilitation and retribution and effectiveness that the correctional system should provide. Rehabilitation: Society seeks preventative action to prevent criminals from committing other crimes by forcing them to undergo training, psychological counseling, or some kind of moral or social education on the need for law-abiding role models.
